<p class="MsoPlainText">Meet William &#8220;Billy&#8221; Gaines II, a former intellectual property associate who gave up practicing law on December 31 to pursue his passion. When asked what firm he used to work for, Gaines demurred. But thanks to the glory of the Internet, the answer was a few clicks away: Vedder Price in Chicago.</p>

<p class="MsoPlainText">As for his passion, well, it&#8217;s beer pong. But Gaines doesn&#8217;t just play what&#8217;s been the college drinking game of choice since the late 1990s&#8211;he aims to make a business out of it. And given that the University of Dayton law school graduate is the founder of the World Series of Beer Pong (the fourth one took place last month in Las Vegas), we&#8217;d say he&#8217;s off to a pretty good start.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText">We caught up with Gaines and talked to the budding entrepreneur about launching a business, , and, of course, re-racking.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Billy, thanks for taking the time today. Let&#8217;s talk beer pong.</span></p>
<p class="MsoPlainText">That&#8217;s the good thing about working on a project like this&#8211;people actually want to talk about things with you! Do you play?</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span><span style="font-weight: bold;">You bet. I play in a </span><span class="at-xid-6a00e55044cbaf88340111686196ed970c"><span style="font-weight: bold;">tournament every year</span></span><span style="font-weight: bold;"> at a bar here in New York. But back to you, the company you founded is called </span><span style="font-weight: bold;">BPONG.com</span><span style="font-weight: bold;">, correct?</span></span></p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText">It&#8217;s actually two LLC&#8217;s that [my partners and I] run. The first is BPONG.com, which is focused on the Web presence and building up the brand in the online community and our merchandising lines. And then we have Beer Pong Events, LLC, which is more associated with the World Series of Beer Pong (WSOBP) and the events side of the business.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">When did you set up these entities?</span></p>
<p class="MsoPlainText">When I was in law school. Once we started putting the events together, we started looking at corporate structures. [The business] started out as a partnership between my partner Duncan Carroll and I when we were sophomores at Carnegie Mellon in 2001. Later we brought in our friend Ben &#8220;Skinny&#8221; Solnik. We all swam together in college. And it&#8217;s kind of just evolved from there.</p>
<p><strong>So how is business?</strong></p>
<p class="MsoPlainText">We&#8217;re not really making much money on what we&#8217;re doing, but a lot of opportunities are presenting themselves. These next six to eight months are going to be really tight financially, but if we can figure out how to make it work hopefully that will make it worth us quitting our jobs. We have some people loaning us small amounts to live off of and start pulling things together.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">I can&#8217;t believe someone would want to give up patent law for beer pong.</span></p>
<p class="MsoPlainText">Just to clarify, I actually have not taken and passed the patent bar. Every firm is different. When I got [to Vedder] they said I should get a couple years experience under my belt and then worry about the patent bar. So I was at that point where they were telling me I should start thinking about taking it, but I never did. I was doing patent work, but I couldn&#8217;t sign off on anything, which for the clients we had wasn&#8217;t a big deal because it was the partners who needed to sign off.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">What&#8217;s your primary focus right now? Please tell me you guys play beer pong all day.</span></p>
<p class="MsoPlainText">It&#8217;s funny, we actually don&#8217;t even play anymore. I did play a couple weeks ago at a tournament in Milwaukee with my girlfriend, and in the summer here in Chicago it&#8217;s fun to play on the rooftop. But right now we really don&#8217;t have the time. One main focus right now is planning the fifth World Series of Beer Pong.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Tell me about that. I saw Rick Reilly&#8217;s column on ESPN.com a few weeks ago about the fourth annual event in Vegas at the Flamingo.</span></p>
<p class="MsoPlainText">In the past it&#8217;s been something we&#8217;ve pulled together in the six months prior, but now we&#8217;re really trying to get a jump on it. And we&#8217;ve always taken a loss on the event, so this year we&#8217;re trying to plan things so we can come ahead and pay off some of the debt that we&#8217;ve accumulated over the years.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Does your IP background help in trying to work out licensing deals or sponsorships?</span></p>
<p class="MsoPlainText">Well, I&#8217;ve always been about building the brand&#8230;maybe that&#8217;s why I fell into trademark and patent law. They complement each other very well. Before we were just trying to establish ourselves as a brand and get recognized, but not necessarily capitalize off of it. There are a million different versions of the game, so who are we, five years ago, to come out and say, &#8220;This is how you play the game?&#8221; We didn&#8217;t want to do that until we made a name for ourselves.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Rules in any sport can be a tricky thing. How did you streamline all the different variations?</span></p>
<p class="MsoPlainText">We had to figure out rules that were fair and minimized disputes. The best example is the &#8216;elbow rule.&#8217; People sometimes play the game where your elbow cannot cross the end of the table. Well that&#8217;s incredibly quasi-subjective. And every time I&#8217;ve seen that rule used, I&#8217;ve always seen verbal confrontations&#8211;sometimes jokingly and other times serious. So we didn&#8217;t want vocal disagreements escalating into physical altercations&#8230;.We tried to develop a set of rules that are not our own, but are kind of a collaboration between a lot of different people. We are not trying to define the game of beer pong, we are trying to define the medium by which the game can define itself.</p>
<p><strong>That&#8217;s quite profound. Now is it true that you don&#8217;t have to play [in the WSOBP] with alcohol?</strong></p>
<p class="MsoPlainText">That&#8217;s correct, no one has to drink the beer. Our rules state that when a cup is sunk, you have to remove it from the game. And there are certainly some teams that just set the beer aside. And in fact everybody plays with four cups filled with water and six cups partially filled with beer. We also try to space the games out so that no person in the competition will play more than one game per hour&#8211;thus no person consumes more than one beer per hour as a direct result of the competition.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">I take it there are legal reasons for all of this? I know there&#8217;s been some blowback against the game&#8217;s increased popularity.</span></p>
<p class="MsoPlainText">We&#8217;re trying to take this out of the college fraternity basement atmosphere and focus on the positive attributes of the game. And that&#8217;s mainly the competition. Americans by nature are competitive. I&#8217;ve seen grandmothers play this game, little kids with water, all because it&#8217;s so easy to play. Almost anybody can pick up a table tennis ball and toss it across a table. But it takes a great deal of practice to really be good at it.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">It&#8217;s about the fun of the game, right?</span></p>
<p class="MsoPlainText">Seriously, whether you&#8217;re the most skilled player or a beginner just learning the game, it&#8217;s fun for everybody. The social aspect [of the game] is also very cool. It&#8217;s kind of like when I swam in college, it&#8217;s the camaraderie of being together with people from different backgrounds. I&#8217;ve seen bodybuilder-types become good friends with the computer science nerd over this game. And it was all because of a common interest in the game of beer pong. And it&#8217;s also fun to play!</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Do you guys use outside counsel to set up events?</span></p>
<p class="MsoPlainText">We have various counsel that we use for various things, including my old firm for some stuff. Right now we&#8217;re primarily focused on IP and brand protection. And we have other attorneys on the entertainment side working on some TV and film deals for us. We haven&#8217;t really settled on one firm, we usually just go to different places depending upon the need that we&#8217;ve had.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">How do you take things to the next level in this horrific economy? I imagine it has to be a tough time to be an entrepreneur.</span></p>
<p class="MsoPlainText">My favorite quote of all time is, &#8220;I refuse to participate in this recession,&#8221; by Ross Shafer. I think we&#8217;re going to have explosive growth this year&#8230;.There&#8217;s a decent chance that you&#8217;ll see us on TV in the next few months and we&#8217;re working on some retail deals through other channels besides our Web site.</p>
<p class="MsoPlainText"> </p>
<p class="MsoPlainText"><span style="font-weight: bold;">Where do you see yourself a year from now?</span></p>
<p class="MsoPlainText">We&#8217;ve taken some risks in the past and we&#8217;re taking bigger risks now by quitting our jobs. Worst case scenario, we go back to what we were doing beforehand.</p>

<p>What Mr. Whitworth didn&#8217;t tell us was who his partner was. That is who I hold responsible for all these shenanigans.<a name="cont"></a></p>
<p>See, if, per sé, I had ever bet money on a beer pong game, it would have probably been 40-50 percent more than I would have bet if I was sober. Say, as a college kid in Tucson, I bet $100 on a game (remember this is all hypothetical). Now, say my roommate &#8212; we will call him &#8220;Will&#8221; for fun &#8212; doesn&#8217;t like to bet money. He is my teammate in this hypothetical beer pong game, and he is nervous and out of his element because there is more on the line than room temperature Keystone Light. Will struggles all through the game, making us lose because &#8220;Andrew&#8221; and &#8220;Ryan&#8221; (our hypothetical opponents) catch fire, (you SOBs!), and beat me. I just lost $100 on stupid beer pong because of Will and his nerves.</p>
<p>Wait, where was I going with this? Oh yeah, Phelps lost $2,000 during Bong-a-palooza. Too bad Rick Reilly wasn&#8217;t there <span style="color: #0582eb;">to Ed Hardy up the entire event</span>.</div>

<p>The fourth annual World Series of Beer Pong tournament, a mainstream drinking game will be held at the Flamingo Hotel and Casino on January 1-5, 2009.  The last beer pong tournament had 600 participants from 39 U.S. States and 3 Canadian Provinces, offering the largest payout in beer pong history of $50,000. The World Series of Beer Pong is the largest, longest-running organized beer pong (aka Beirut) tournament in the world, created by beer pong players, for beer pong players.</p>
<p>Just don&#8217;t ask them to recite the alphabet backwards when it&#8217;s all over. The game has come a long way from its wobbly roots in beer-soaked fraternity house basements, but the rules haven&#8217;t wavered much.</p>
<p>Beer pong involves two teams that face-off from opposite ends of a long table. Competitors arrange 10 plastic cups in a triangle on each end of the table, then take turns attempting to lob ping pong balls into other team’s cups. The first team to successfully land balls in each of the other team’s cups wins.</p>
<p>Games are played on 8-foot <a title="Official Beer Pong Tables" href="http://www.collegebeergames.com/beer-pong-tables.php" target="_blank">Official Beer Pong Tables</a>, and WSOBP Rules regulate all gameplay. All players must sign up before December 5, 2008. No late sign-ups will be accepted.  The tournament is open to anyone, male or female, ages 21 or older. <p>1) The Beer – What are you drinking? Make sure that it’s cheap, but not too cheap, and that you don&#8217;t accidentally grab a nearby cup filled with whiskey (a pleasant surprise) or a cigarette (even better).</p>
<p>2) The Cups – Make sure they’re filled high enough, for those of you who don’t know, two is standard, three is better, four is too much. If you puss out and only do a little in each, a line drive shot will send the cup straight to your shoes.</p>
<p>3) The Table – You can pretty much play beer pong on anything, a fold-out, a surfboard, two chairs and a stolen road sign, whatever. But know your table, especially if you’re playing with the douche-tastic bounce rule. You want to know how much bounce you’ve got before you attempt a trick shot and you look like a tool.</p>
<p>4) The Water Cup – People don’t often understand that water cups have to be changed. This is especially true if you’re playing either A) outside or B) in your friend’s dirty ass apartment. After about the third game, the water cup will be so full of dirt, leaves and hair, it&#8217;d be more sanitary if you gave it a spit shine yourself.</p>
<p>5) The Environment – It may sound stupid to take stuff like wind into account, but it’s a ping pong ball, not a golf ball, the wind will affect it significantly more. Also, never play on a balcony, the ball rolls off and you have to run three flights down for the game to be able to start again.</p>
<p>6) Your Partner – There are two strategies to selecting a winning partner. The first is obvious, you’re best bud who totally kicks ass at pong and when the two of you team up you destroy everyone in your path. But if he’s not available, the strategy is simple, find a chick with huge boobs. Any male competitors will be distracted, and even females will as well if they’re big enough. Foolproof.</p>
<p>7) Your Form – Pick a style and stick with it. Don’t flop around between “all-knees,” all-arm,” “all-wrist,” “loft-shot” and “line drive.” Just pick one, and eventually you’ll find your groove in that style. And then stay with it the rest of your life.</p>
<p> <img src='http://ilovebeerpong.net/wp-includes/images/smilies/icon_cool.gif' alt='8)' class='wp-smiley' /> Your Attitude – It’s only acceptable to trash talk the opposing team if they’re your friends. If it’s two random kids who just wandered into your house from off the street, then play nice, you can win and not be a dick about it. However, the exception to this rule is if they’re from your rival school. Tear their every move apart until they run home crying.</p>

<p>Congratulations! You just won a game of Beer Pong… or is it Beirut?</p>
<p>The “Beer Pong versus Beirut” controversy has plagued the American social scene for some time now. Most can agree that knowing how to play a good game or Pong or ‘Rut is key to a fulfilling and well-rounded college experience, but some get into heated debates over what the game is actually called.</p>
<p>Where did this whole nomenclature argument originate? Beer Pong was <a href="http://www.dartmouthindependent.com/archives/2004/09/second_test.html"><span style="color: #120769;">originally </span></a>a game played with ping pong paddles, as seen in <a href="http://www.imdb.com/title/tt0486551/"><span style="color: #120769;">Beerfest</span></a>. The paddle version, which appears to be the original version of the game, was allegedly created at Dartmouth College, a school reputed for its students’ <a href="http://www.youtube.com/watch?v=e1_u2Yysf7I&amp;feature=related"><span style="color: #120769;">drinking prowess</span></a>. It is rumored that the paddle-less adaptation of Beer Pong was formulated in the 1980s by either Lehigh University or Bucknell University in reference to bombs being dropped in Beirut during the Lebanese Civil War, according to the <a href="http://www.dailyprincetonian.com/archives/2004/11/19/opinion/11525.shtml"><span style="color: #120769;">Daily Princetonian</span></a>.</p>
<p><a href="http://www.collegehumor.com/"><span style="color: #120769;">College Humor</span></a> conducted a survey to see what most people preferred to call the famous drinking game. <a href="http://www.collegehumor.com/pongmap"><span style="color: #120769;">The results</span></a>: 77 percent of people call it Beer Pong, while 23 percent call it Beirut.<br />
While East coasters have a tendency to call the game Beirut, arguing that Beirut sounds classier and that Beer Pong is too easily confused with the paddle version of the game, the rest of the country is more likely to call it Beer Pong.</p>
<p>“I call it Beer Pong,” says Claire Hannah, a Weinberg freshman from Kansas, “even though Beer Pong technically should be played with paddles.”</p>
<p>“I don’t really care what people call it, I just prefer ‘Rut,” said Weinberg freshman and Massachusetts native Wendy Lei.</p>
<p>Chances are, you’ll never get into a fist fight over these two names. Knowing the history may make for interesting conversation fodder, but in the end, both names are socially acceptable and it mostly just comes down to a matter of personal preference. If you’re sick of arguing over it, though, try one of these variations.</p>
<p><strong>Strip Beer Pong</strong><br />
<em>Setup:</em></p>
<ol>
<li>You’ll need four players, a table suitable for beer pong, and 20 Solo cups.</li>
<li>Each team should use a sharpie to write an article of clothing on the bottom of each of their ten cups</li>
<li>Trade cups with the members of the opposing team who have also just completed step one.</li>
<li>Set the cups up in standard pyramid form and fill equal amount of beer in each cup.</li>
</ol>
<p><em>Gameplay:</em> Start playing as you would play traditional beer pong. Once a player sinks a ball in one of the opposing team’s cups, a member of the opposing team must choose to either drink the beer or take off the article of clothing written on the cup. But don’t yet pick up the cup with the ball in it: The ball must get in the cup a total of <em>two times</em> before the cup is removed from the game. The second time the ball gets in on cup, the opposing team must do whatever they chose not to do the first time the ball got in — either drink the beer or take off the article of clothing. If a team lands the ball in two different cups in one turn, the team gets to go again, just like in traditional beer pong. If both team members sink the <em>same</em> cup, BOTH members of the opposing team must take off the article of clothing under the cup, as well as finish the beer.This game always makes for a good ol’ raunchy time. Just remember not to put things like ’sombrero’ under the cup, unless in fact one of the opposing team members is wearing a sombrero.<br />
<strong><br />
Baseball</strong><br />
<em>Setup:</em></p>
<ol>
<li>Gather two teams, each with at least one person. Each team gets a quarter or ping pong ball (both work; use whichever you prefer or have around).</li>
<li>Get four different-sized cups, from shot glasses to pitchers, and place them in a line in order from smallest to largest, with the smallest closest to where you are shooting from.</li>
<li>Fill the glasses with beer.</li>
</ol>
<p><em>Gameplay:</em><br />
This game is the best alternative to playing baseball drunk. Each glass is like a base: The smallest glass counts as a single hit and the largest glass is a home run. You can figure out the rest. Each team selects a batting order. The objective of the game is to get as many hits as possible. You do this by throwing a ping pong ball from a designated distance into the cups. Once a cup is sunk, the other team must drink it. Once a cup has been drunk, it should be refilled immediately. If a cup is missed, it counts as an out for that team. Each team is alloted three outs. After three outs, you must switch teams up to bat. This goes on for a total of nine innings. The score is kept just like in regular baseball. If someone hits a double and then the next person hits a double, the person originally on second base gets a run for the team, and someone else is left on second base. The team with the most runs wins.</p>
<p><strong>Beirut Free-For-All</strong><br />
<em>Setup:<br />
</em></p>
<ol>
<li>You’ll need three players on each of the two teams, and six ping pong balls — one for each player.</li>
<li>Form three triangles, consisting of three cups each, on both sides of the table. The three triangles on each side should be next to each other.</li>
<li>Fill the triangles with beer, using one can per triangle.</li>
</ol>
<p><em>Gameplay: </em>This free-for-all, dodge-ball-esque game can get a little crazy. Start with each player standing in front of a triangle. Count down to start, and start shooting. Any ball is up for grabs. If a ball lands in your triangle, you can’t start firing again until you finish the beer and take the cup away. Once your triangle is finished, you’re out of the game. The team with the last remaining triangle wins.</p>
